TERMS OF USE

Effective date: [DATE] Last updated: [DATE]

These Terms of Use apply to breezemh.com and all pages operated by Breeze Mental Health (“the Practice”). Using the website means accepting these terms.

1. Informational purpose only

The content on this website is general information about psychiatric care, conditions treated, and the Practice itself. It is not medical advice, a diagnosis, or a treatment recommendation, and it does not replace evaluation by a licensed clinician. Care decisions should be made with a provider who knows your history.

2. No provider-patient relationship

Reading this website, sending an email, or requesting an appointment does not create a provider-patient relationship. That relationship begins only after intake is completed, Breeze Mental Health accepts the individual as a patient, and the required consent documents are signed.

3. Emergencies

Breeze Mental Health is an outpatient practice and does not provide crisis or emergency services. Website messages, email, and voicemail are not monitored around the clock. In an emergency, dial 911, call or text 988 (Suicide & Crisis Lifeline), or go to the nearest emergency room.

4. No affiliation with the “Breeze Mental Health App”

Breeze Mental Health is a psychiatric practice with offices in Pennsylvania and Ohio. It has no affiliation, ownership, partnership, or business relationship with the mobile application marketed as the “Breeze Mental Health App” or with its operators. Account, billing, subscription, and cancellation questions about that application cannot be handled by this Practice.

5. Scheduling and third-party platforms

Appointment booking and the patient portal are hosted by OptiMantra, a third-party platform. Use of the portal is governed by OptiMantra’s own terms and privacy practices, not by these Terms. A requested appointment is not confirmed until Breeze Mental Health confirms it.

6. Email and website communication

Email and standard web forms are not secure channels and should not be used for clinical or sensitive information. Anything sent this way may be accessed by others in transit. Health information belongs in the patient portal or on a phone call. Response times for website and email messages are not guaranteed.

7. Where services are available

Breeze Mental Health treats patients who are physically located in states where its providers hold an active license: Ohio, Pennsylvania, Massachusetts, Maryland, and Washington. Nothing on this website is an offer to provide care in any other state.

8. Accuracy and availability of information

Provider availability, accepted insurance plans, self-pay rates, office locations, and hours change over time. Information on this website is maintained in good faith but is not a guarantee of coverage, cost, appointment availability, or clinical outcome. Insurance benefits are determined by the insurer, not by information published here.

9. Intellectual property

Text, images, graphics, logos, and page design on this website are owned by Breeze Mental Health or its licensors and are protected by copyright and trademark law. Personal, non-commercial viewing is permitted. Copying, republishing, scraping, or reusing content for other purposes requires written permission.

10. Acceptable use

Visitors may not use the website to transmit malicious code, attempt unauthorized access, disrupt or overload the site, collect data through automated means, impersonate another person, or engage in unlawful activity.

11. Third-party links

The website links to outside resources such as insurers, provider directories, social platforms, and crisis services. Breeze Mental Health does not control those sites and is not responsible for their content, accuracy, or privacy practices.

12. Disclaimer of warranties

The website is provided on an “as is” and “as available” basis, without warranties of any kind to the extent permitted by law, including warranties of accuracy, uninterrupted access, or fitness for a particular purpose.

13. Limitation of liability

To the fullest extent permitted by law, Breeze Mental Health is not liable for indirect, incidental, or consequential damages arising from use of, or inability to use, this website. This section applies to website use only and does not limit obligations related to clinical care delivered to established patients, which are governed by the applicable treatment consents and by state and federal law.

14. Privacy

Website data practices are described in the Website Privacy Policy. Protected health information held by the Practice is governed by the Notice of Privacy Practices under HIPAA.

15. Changes to these Terms

These Terms may be updated at any time. The effective date above reflects the current version, and continued use of the website after an update means accepting the revised Terms.

16. Governing law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. [CONFIRM: state of the practice entity]
